| 摘 要： | 通过对错误记忆的研究可看出,由于错误记忆导致的证言问题是案件侦查和审理的难点。对证人证言中是否有错误记忆,可运用个体差异研究、误导信息范式提问、脑生理研究的方法来判断。要应对证人证言错误记忆造成的虚假供述,要从询问方式上改进,使用认识访谈法;找出逻辑上的问题,用客观的态度对待证人证言;使用脑生理检测技术。

| Abstract: | Through the study of false memory,we find that testimonies derived from false memory set difficulties for the investigation and trial of cases.The research of individual differences,paradigm inquiring of misleading information and the research of brain physiology can be applied to determine if there is false memory in the testimonies of witnesses.To deal with the false testimonies derived from false memory,police should improve the method of inquiring,for example,to adopt the method of acquaint-and-interview;find logical contradictions and take an objective attitude towards the testimonies;and apply the technology of testing of brain physiology. |
