重大环境污染事故罪的若干问题

重大环境污染事故罪的罪过形式应该是过失,不包括直接故意和间接故意。我国刑法中不存在严格责任,重大环境污染事故罪也不例外。但从应然的角度说,应该确立重大环境污染事故罪的严格责任。在现行刑法中,重大环境污染事故罪是结果犯,而从危害程度和预防的需要看,有增设本罪的危险犯的必要。
