谈合同法中的“情事变更”原则

情事变更原则是以诚实信用原则为出发点的债法的重要原则。其含义是指合同有效成立之后,非因当事人双方的过错而发生的情事变更,致使合同不能履行或如果履行会显失公平,因此根据诚实信用原则,当事人可以请求变更或解除合同。双方当事人可依情事变更原则就合同的变更部分进行协商,协商不成可请求法院公裁。由于我国的经济发展状况及法制现状,合同法并没有采纳情事变更原则,但在将来制定民法典时应将其收入。

On the"Change of Circumstances"Principle in the Contract Law

The principle of change of circumstances is the important principle of debt law that make the honest&credit principle as the starting point.It means that when the contract is established effectually,the situation change and the privy is innocent,and the contract can't be performed,according to the honest&credit principle,the privy can ask for change or abolish the contract.The both privies can negotiate with the change of contract according to changed circumstances,if the negotiation burst,they can ask the court to arbitrate.Because of the economic& jural actualities of our country,the contract law didn't adopt the principle of changed circumstnces.But the principle of changed circumstances should be adopted in the civil law code in the future.
