| 摘 要： | MP3是一种以计算机播放 ,存储数字音乐格式。MP3音乐相关使用行为主要包括以 MP3标准压缩他人音乐或录音制品的行为 ,将 MP3音乐上载到网络上的行为、开放资源共享行为 ,从网络上下载 MP3音乐的行为。MP3音乐相关使用行为的侵权认定应综合各种因素加以判断。对于 MP3侵害著作权问题的防范与对策 ,除了事后的司法救济方式外 ,还应建立健全网上付费机制。并借鉴国外先进技术解决方式。
