法治视域下的村规民约

中共十七大报告首次明确将"基层群众自治制度"纳入中国特色的政治制度,体现了国家完善和发展村民自治制度的决心。作为村民自治制度核心内容的村规民约也日益受到关注。村规民约自身的特点及其特殊的地位,使其与"法治"之间存在着天然的内在张力。通过对村规民约与法治的内在关联正反两方面的剖析,揭示出"村规民约"对法治的推动保障作用与客观消极影响之间的矛盾,并从法律多元格局的角度,为协调这一矛盾,推进村规民约的完善和发展提出一些建议和设想,以期实现国家法律与民间秩序的良性互动与和谐发展。
