我国未成年人犯罪刑罚执行制度研究——兼论社区矫正制度

未成年人犯罪刑罚执行制度的基本理念在于保护和教育,对此,我国目前的体制虽然取得了一定成效,但仍存在具体操作性不强、执行主体不清、责任主体不明等缺陷,缺乏系统化。而社区矫正恰是完善我国未成年人犯罪刑罚执行制度的优先选择,应对原有项目加以改进并进行整合,同时在立法上应进一步完善刑事法、构建特别法体系,完善慎逮制度、充分发挥暂缓起诉制度的保护和帮教作用,重构未成年人缓刑制度、取消对未成年人的劳动教养等。

The Enforcement of Criminal Punishment on Juveniles and Community Correction in China

Protection and education is the basic idea of enforcement of criminal punishment on juveniles.In China,though some progress has been made in these years,there is still much room for us to improve.The main problems lie in that the juvenile delinquency system sometimes does no operate well,the operators are not well defined and their responsibilities are not clearly delineated.In this author's opinion,to improve the enforcement of criminal punishment on juveniles,community correction is our prior choice.We should change and rearrange our original criminal justice programs,improve the criminal law by way of legislation,establish a especial law regime,advocate the principle that arrest should be made discreetly,and fully exert the function of protection and education related to the suspension of prosecution,rebuild the juvenile probation framework,and abolish the labor reform and rehabilitation of juveniles.
