论司法能力建设视野下的人民陪审制度

人民陪审制度是我国一项重要的司法制度,是人民群众直接参与国家管理的具体体现,是审判机关接受群众监督,保证司法公正的一项有力措施,是司法民主化的一种体现。然而,现行的人民陪审制度依然存在缺陷,以致影响人民陪审员的司法能力,本文试图探讨人民调解制度对人民陪审制度的影响与补充,为相关问题的解决提出一种新的思路。

On People's Jury System under Vision of the Judicial Ability Construction

The people＇s jury system is an important legal system of our country,is the concrete manifestation of people＇s direct participation in the state management,is the effective measures to guarantee the judicial fairness through that the judicial organization accepts the people＇s supervision,is manifest of the judicial democratization.However,the present people＇s jury system still has the flaw,and affects the people juror＇s judicial ability,this article attempts to discuss the influence and the supplement of people＇s mediation system on the people jury system,give a kind of new mentality for the related problem＇s solution.
