光污染防治的立法探析

由于没有直接的法律依据,当民众受到光污染侵害时,寻求法律救济比较困难。为此,需要制定《光污染防治法》,从法律上明确界定光污染及其救济制度,切实保障公民的正当权益,以弥补立法空白。本文通过分析我国光污染现状,在借鉴国外的立法现状和继承我国现有可行制度的基础上,论证我国光污染立法的必要性和可行性,提出建构我国光污染防治的法律框架的建议。

The initial inquiry about the legislature of the light pollution prevention law

When people are exposed to light pollution,they find it difficult to receive relief from law for lack of direct legal basis,which calls for an urgent need to establish light pollution prevention law.Both definition of light pollution and relief system should be specified in order to ensure people's health and security and fill up the legislative vacancy.This article demonstrates the necessity and feasibility of legislating light pollution prevention law through analysis of present condition.Furthermore,it has put forward suggestion about constructing framework of Chinese light pollution prevention law on the basis of using the legislative experience of other country for reference and inheriting Chinese current system.
