| 摘 要： | 传统的法思维包括：中国的道德主义和工具主义二分范式与西方的价值、规范、事实三分范式。按照美的规律建造法，是一种审美的法思维范式。这种新的范式，最基本的是复现人的类本质即美的极限。这需要从两方面着手，一是正确地表达法的外在特征，二是正确地表达法的内在价值。审美的法思维范式有重要的理论和现实意义。

| Abstract: | Traditional law-thinking involves the Chinese dichotomy of moralism and implementationism as well as the Western trichotomy of value, normality and facts. To make laws according to the law of beauty is a pattern of aesthetic law-thinking, the essence of which is to present the categorical nature of human, i.e. the extreme of beauty, by properly presenting both external features and internal values of laws. This pattern bears great theoretical and practical significance. |
