| 摘 要： | 知识产权法有促进竞争的一面,但与竞争又不可避免地存在内在冲突。竞争法对知识产权具有“抑”与“扬”的双重功效,既能有效地保护知识产权,又对知识产权领域中的不正当竞争行为加以规制。在协调知识产权法与竞争法的关系时,竞争法应对行使知识产权的正当行为予以豁免,对不正当行为予以约束。
