| 摘 要： | 检察一体与检察独立作为现代检察权运行的“双重控制”机制,一方面检察系统内部组织领导遵循一体化方式,上命下从;另一方面,检察院对外行使检察权时,遵循独立原则。但是二者在运行过程中存在矛盾与冲突,如果弱化检察长的案件指令权,强化其案件收取和转移权,办案责任制就会在此起到非常重要的监督作用,并能缓和检察权运行机制中的紧张关系,进而寻找出应然价值选择。
