试评《物权法（草案）》对银行业务的影响

物权法是调整财产关系的重要法律,与我们每个人的切身利益都息息相关,银行亦不例外。为此,我们对《物权法(草案)》进行了认真研究,以期更好地指导业务的开展。该草案将对银行产生有利的影响,比如扩大了可用于担保的财产范围、增加了最高额质押这种担保形式、建立了方便快捷的统一登记制度等,这些都将极大地促进银行信贷业务的稳健发展。但是,我们也应看到,草案给银行带来机遇的同时,也使银行面临着更大的挑战。新的异议登记、预告登记、将来的动产抵押以及居住权制度等,都对银行提出了更高的要求。在对该草案的有利影响和不利影响进行分析的基础上,本文还提出了银行的应对措施。

Comment the Effect of the Real Law(draft) on the Businesses of Bank

Real law is a law which adjust the property relationship, it intimate with everyone's interest, the banks are not the exception. So we researched this law carefully, aiming to instruct our businesses. This draft is benefit to the banks in some field, such as it enlarged the field of the insure properties, added the floating mortgage and also regulated the express and obedient union registration. This will greatly promote the bank's loan businesses steadily. But we also see that this draft bring the chances with the banks, at the same time bring challenges with them. The new protest registration, preregistration, the coming moveable property mortgage and inhabitant right and so on, a higher requ est burden on the banks.
