论环境法的终极价值——基于系统论的研究视角

从系统论的视角来看,地球是由人类社会系统和自然系统构成的有机整体,其中任何一个系统的破坏都会带来整个地球生态系统的不稳定。因此,以协调人与自然关系为己任的环境法应将其终极价值定位为生态整体利益。这种生态整体利益是人类整体利益与自然生态整体利益的有机结合,也是当代生态整体利益与后代生态整体利益的统一。要实现环境法的生态整体利益价值,必须克服观念上、法律制度层面和国际合作方面的障碍。

The Ultimate Value of the Environmental Law--On the Basis of the Visual Angle of the Theory of System

Seen from the visual angle of the theory of the system, the earth is an organic whole made of human society system and natural system, of which the destruction of any system will bring the instability of the whole ecosystem. So the environmental law, which takes the coordination of the relation of human being and nature as his own duty, should orient its ultimate value to the whole interest of ecology. The whole interest of ecology is an organic combination of the whole interest of human being and the whole interest of natural ecology, and it is also the unity of the whole interest of contemporary ecology and the whole interests of ecology of later generations. To realize the value of whole interest of ecology of the environmental law, we must overcome the obstacles of idea, the legal system and the international cooperation.
