In this paper,it will be resolved progressive about background,cause and the conditions of the normal operation of ＂homicide case must be cracked＂,systematic analysis of the both positive and negative effects of Judicial practice,and trying to indicated that in the standard and restriction of the eliminating illegal evidence,the criminal policy of ＂homicide case must be cracked＂ will be produced more active effect in the criminal judicial practice of the present of China.
