非法组织卖血罪的认定和处罚问题研究

《刑法》第333条规定的非法组织卖血罪,在认定和处罚方面还存在较大的争议。在认定方面,《刑法》第13条但书的规定是非法组织卖血罪与一般非法组织卖血行为的界限标准,是否使用暴力、威胁方法是非法组织卖血罪与强迫卖血罪的区分关键,被组织卖血者的全部环节的完成为非法组织卖血罪的既遂根据;在刑罚方面,《刑法》第333条第2款中“前款行为”不只是针对强迫卖血罪而言,还包括非法组织卖血罪,“他人”指的是卖血者而不包括用血者,“伤害”应当限制解释为“重伤”。
