我国民事诉讼诉答程序的完善

我国民事诉讼诉答程序在司法实践中表现为有"诉"无"答"和少"诉"少"答"两种形式,呈整体虚置状态,既增加了当事人的讼累又妨碍了民事诉讼效率的提高。从类型上,按照不同的标准,民事诉讼诉答程序可以分为权利型诉答程序与义务型诉答程序、通知型诉答程序与事实型诉答程序、静态型诉答程序和动态型诉答程序。我国民事诉讼应该建立义务型、通知型和动态型为一体的诉答程序。
