“被告人认罪案件”办理问题研究——以检察机关为视角

“被告人认罪案件”司法程序作为一项具体程序，是我国刑事诉讼的有机组成部分。应否简化审判程序，简化到何种程度，和我国的历史传统、法律文化、诉讼习惯尤其是现实案多人少的现状有密切联系。这也足以解释为何刑事诉讼中存在简化审理而行政诉讼中却没有类似的制度。因此，我国的“被告人认罪案件”简化审理制度的构建，也应适应我国基层司法的现状，做出灵活、务实的选择。

Research on Case Handling of Defendant's Admitting Guilt——From the Angle of People's Procuratorate

As one specific procedure, the judiciary procedure of case of defendant＇ s admitting guilt is necessary component of China＇ s criminal suit. Whether simplify trial process and which level will be simplified closely relates to China＇ s history traditions, law culture and suit habit, especially the pre, sent condition, that＇ s more cases and fewer judges, which can explain that the reason why there is simplified trial in criminal suit but not in administrative suit. So the establishment of simplified trial system of case of defendant＇ s admitting gnih meets the present situation of basic judicature of China, and it is a flexible and practical choice.
