| 摘 要： | 《唐律》代表了中国古代立法的最高水准。《唐律》中的正当防卫可以分为夜间防卫、防卫自身和防卫父祖。在立法体例方面,《唐律》在分则中的个别条款中规定正当防卫,而现行刑法在总则中规定正当防卫。在成立条件方面和法律效果方面,《唐律》和现行刑法虽然有某种程度的相似之处,但总体而言两者相去甚远。研究《唐律》中的正当防卫,比较其与现行刑法相关规定的异同,对于当今的司法实践和理论研究具有重要意义。

| Abstract: | Tang code stands for the most top level of legislation of ancient China.Comparative study and analysis on related provions on Justifiable defence contained in Tang Code and the current Criminal law of the PRC will be helpful to judicial practice and criminal theory.Justifiable defenses of Tang Code can be classified into three types: Justifiable defence at night , Justifiable defenses for himself andJustifiable defenses for parents and grand parents.On legislation model aspect, Tang code stipulates Justifiable defenses in specific provions while current Criminal law of the PRC stipulates it in general provions.On elements and force effect aspect, although there are some resemblance between Tang code and the current Criminal law, as a whole, the dissimilarity is apparent. |
