| Abstract: | Neither the ownership of water nor the credit arising from a water contract is included in the concept of water rights because they are totally separated concepts and independent to each other. Water rights are impossible to be originated only from administrative authorization without the precondition of ownership of water resources. And the water rights can not be properly originated by auction in China. These issues have to be analyzed according to the specific case because of the varieties of the holders of the water rights. |
