优先购买权竞存问题研究

在同一出卖标的上就可能存在数个优先购买权且效力相互冲突的现象,对此不能称为优先购买权的竞合、聚合等,而应当称为优先购买权的竞存。优先购买权的竞存有其特殊的构成要件和处理原则,不能一概而论。对于二者竞存的效力冲突之处理,不能机械地设定一个标准,而应当遵循处理优先购买权竞存的原则,在无特殊条件的情况下,承租人优先购买权的效力应当高于共有人优先购买权的效力。

On the Competition of Preemptive Right

While there appears that multiple preemptive rights exist in the same object for sale and the effects of multiple preemptive rights conflict one another, this phenomenon should be called competition of polymerizations but not coincidence or aggregation of polymerizations . There are special constitutive requirements and solvent rules of competition of preemptive right, so it depends to diffirent condition.As regards the solvent to the conflict of the effect of the two preemptive rights, it is considered to obey the solvent rule of preemptive right but not a fixed or a single way, that is to say, in the general circumstance the lessee preemption should be superior to joint owner,otherwise in the special circumstance .
