| 摘 要： | 近现代刑事诉讼制度的发展呈现出文明化、民主化、科学化的世界性趋势,然而由于现行诉讼制度的不健全和传统诉讼观念的消极影响,在各国刑事司法实践中仍存在大量的秘密刑讯和变相刑讯。为防范刑讯逼供的产生,从宏观上看应从制度完善与观念更新两方面完善刑讯逼供的应对策略。

| Abstract: | Modem criminal litigation system has been showing on international tendency of civilization,democracy and science.But due to the imperfection of the present criminal litigation system and the negative influence of the tradi- tional legal idea,there still exists an amount of torture in private and in disguised form.In order improve the countermea- sures against torture,two ways are suggested;one is to perfect the litigation system,another is to change the legal idea. |
