| 摘 要： | 合同中的严格责任有对有过错与无过错者同罚,有不利于实现合同正义、不利于准确认定责任等缺陷,但它也有促使当事人严肃对待合同,利于合同的严肃性等优点。只要采取一些方法来弥补缺陷,其确立必然会稳定交易秩序,保障交易安全。

| Abstract: | The strict liability shall punish the fault makers and no fault makers equally, there are the defects such as that it is disadvantageous to realize the contract justice, and it is unfavorable to identify the responsibilities correctly, but it also has the merits that it urges the persons involved to deal with the contract strictly and advantageous to the strictness of the contract. Only can we adopt some methods to make up the defects, and its establishment shall inevitably be able to stabilize the order of the business transactions and protect the safety of the business transactions.
