想象竞合犯处断原则的困境与重构

目前关于想象竞合犯的三大处断原则均存在不足。对此,必须以全面评价原则与禁止重复评价原则为指导,以行为无价值、结果无价值、主观罪过三要素为核心,构建新的想象竞合犯处断规则,即想象竞合犯的处刑应当是数罪中最重之宣告刑加上余罪之宣告刑的2/3。该处断规则必须在《刑法》第69条之下运行,即遵守限制加重原则,且如果数罪中有死刑或无期徒刑的,采取吸收原则,执行死刑或无期徒刑;如果数罪中有判处有期徒刑和拘役的,同样采吸收原则,执行有期徒刑;数罪中有判处有期徒刑和管制,或者拘役和管制的,采逐次执行原则,有期徒刑、拘役执行完毕后,管制仍须执行。

Predicament and Reconstruction of the Principle of Judgement toImaginative Joinder of Offenses

At present,there are shortcomings in the three principles of judgement to imaginative joinder of offenses.Therefore,we must take the principle of comprehensive evaluation and the principle of prohibiting repeated evaluation as the guide,and take the three elements of worthless behavior,worthless result and subjective sin as the core,and construct a new judgment rule of imaginative joinder,that is,the sentence of imaginative joinder should be two-thirds of the heaviest sentence of several crimes plus the sentence of remaining crimes.The decision-making rule must run under Article 69 of the Criminal Law,that is,abide by the principle of aggravated restriction,and if there is death penalty or life imprisonment in several crimes,we adopt the principle of absorption and execute death penalty or life imprisonment.If several crimes are sentenced to fixed-term imprisonment and criminal detention,the same principle of absorption is adopted and fixed-term imprisonment is implemented.If several crimes are sentenced to fixed-term imprisonment and public surveillance,or criminal detention and public surveillance,the principle of successive execution shall be adopted.After the execution of fixed-term imprisonment and criminal detention,public surveillance shall still be executed.
