| 摘 要： | 优化检警职权配置，理顺检警关系，是规范司法行为，优化司法职权的重要内容。我国目前的检警关系存在诸多缺陷，导致侦查行为监督制约措施缺失，出现了所谓“侦查中心主义”式的刑事诉讼。如何制约侦查机关滥用侦查权力，理顺检察机关与警察机关的关系，是实现规范司法行为，达到司法行为优化配置的必须首要解决的问题。

| Abstract: | Optimizing the configuration, and straightening out the power relation between police and procuratorate, is the important content of standardizing judicial powers, and optimize judicial. The police and procuratorate relationship in our country, there exist many defects in investigation supervision and control measures at present, lead to the socalled ＂missing＂ investigation of criminal procedure. How to restrict the investigation organ abuse investigation power, straighten out the procuratorial organs and the police authorities relationship, is the problems to be solved to standardize judicial practices, and optimize configuration of judicial actions. |
