犯罪过失阻断事由——信赖原则研究

根植于新犯罪过失理论的信赖原则,是社会发展的必然,它在阻断犯罪过失方面具有极其重要的作用,也正是因为信赖原则的存在,方使得近现代社会的危险业务得以全面地开展。本文主要介绍了信赖原则理论的确立、信赖原则的理论基础及其适用的条件,在此基础上,笔者提出,信赖原则在我国完全存在着全面引进的可能性,而且,在信赖原则适用的范围方面还具有较大的扩展空间,即在行为规范化、社会化程度较高且存在多数人有组织性地分工协作,共同实行有危险性作业的领域,均存在适用该原则的余地。

A Study of the Trust Principle: Criminal Negligence Obstructing the Matter Origin

The trust principle,based on the new theory of criminal negligence,is the inevitable development of society.It's of extremely great importance in obstructing criminal negligence.And it is because of the existence of the trust principle that risky business developed in full scale in contemporary society.The article introduces the establishment,the theoretical basis of the trust principle and its application conditions.Based on this,the author proposes that the trust principle be possibly adopted by our country and the application scope of it can be further expanded,namely in the field with the normalized behaviors, high extent of socialization and many people working cooperatively with organization and jointly conducting risky business.
