法律移植及其本土化现象的关联考察——兼论我国法的本土化问题

法律移植是人类文化交流的必然产物,任何社会的文化都不能孤立地存在,但是各民族国家由于具有独特的地理环境与人文环境,使得法律文化的交往产生了一定的困难,所以移植法律必须与本国的传统结合起来,实现法律的本土化.协调移植法律与本土资源会使得固有文化得以传承,又能开启未来,与世界接轨.中国法制自中华法系破产后走过了一段艰难的路,至现在仍不免"幼稚",因此移植自不能避免.然而在一个具有悠久历史文化传统的国度里实现移植,又必须充分考虑本土化的问题,即使在诸多领域法律日益趋同化的今天,本土化依然是一个重要而有意义的话题.

Investigation into the Interrelation between Legal Transplantation and Its Localization--On Localization of Chinese Law Simultaneously

Legal transplantation is the inevitable outcome of exchange of culture of mankind.Culture of each society can't exist independently.It is diffcult for legal cultures to exchange because each state has peculiar physiological environment and cultural environment. Therefore,legal transplantation should combie with domestic tradition to achieve legal localization. It carries forward the intrinsic tradition and Paves the way for the future to bring into line with the world to coordinate legal transplantation with local resources. Chinese legal system has experienced hardships since Chinese civil laW system fell through.Now it is stll so naive that it is inevitable to transplant. However, localization is still an important and significant subject to achieve transplantation and to fully consider localization in a country which has long history of cultural tradition,even if laws in various fields tend to reach unanimity today.
