义务教育阶段公民受教育权的法律保护

在我国,义务教育阶段长期存在的问题,近年来随着教育体制的改革日益显露,公民的受教育权频繁受到侵害已经成为一个不争事实。政府与公民之间权利义务应当如何配置,这一矛盾将学校置于相对突出的位置。同时,政府与家长应当在何种限度内承担起各自的义务,并以此来保障义务教育的有效实施显得至关重要,因此在立法中明确政府责任与家长对未成年子女照顾权的范围,并施以有效的救济措施,成为真正保障公民享有受教育权所必需的立法前提。
