| 摘 要： | 转化犯是我国刑法所独有的名称，是对犯罪行为发生转变后罪数形态的概括。转化犯的提出拓展了刑法罪数形态的理论，对司法实践有一定的指导意义。但我国有关转化犯的刑事立法存在一定的缺陷，需加以完善。
