| 摘 要： | 作为一种刑事强制措施,逮捕有利于保障刑事诉讼的顺利进行,实现国家刑罚权,但出于保障公民权利的需要,应对逮捕这一国家权力进行必要的限制.比例原则以如何限制国家权力,保障公民权利为内容.我国应当遵循比例原则的要求,完善逮捕立法.
