| 摘 要： | 当被害人受到犯罪分子的侵害 ,从犯罪分子那里得不到赔偿或充分的赔偿时 ,国家应当给被害人以补偿 ,帮助被害人摆脱困境。本文对国家补偿制度的产生和发展、国家补偿制度的理论基础和建立国家补偿制度的必要性进行了论述 ,并在此基础上 ,对我国建立国家补偿制度的基本框架提出了构想。

| Abstract: | When the victims suffers the violation of crime,he can not get the compensation or enough compensation from the criminals,the nation should compensate the victims,and help the victims get away from the predicament. This article discussed the creation,development,theories and necessity of the national compensation system.Furthermore,the article advances the national compensation institutional basal frame of our country. |
