| 摘 要： | 刑罚一直被誉为犯罪防治的万灵药,然则,其效力真如所说吗?笔者从刑罚的理论和实践基础方面分析了刑罚的效力问题,最终得出结论,刑罚的效力是有限的,并提出了一系列的修正路径,以求教于同仁。
