论WTO规则对我国纺织业立法和实践的影响及对策

入世后,对中国政府来说,保证国内的有关法律法规符合WTO规则和我国对外承诺,并使这些法律法规在全国得到统一实施,既是义务,又是依法保护自己、发展自己的一项重大举措。而WTO规则只有转化为国内法才能在中国适用。因此,纺织业的立法任务很重,急需制定、完善一批新的法律法规,同时,又要清理、修改或废止与WTO规则和我国对外承诺不相符合的法律法规、规章和政策措施。因而研究WTO规则对纺织业立法理论和实践的影响以及探索应对外国反倾销的对策,具有特别重要的现实意义和深远的战略意义。

On WTO Rule''''s Influence in the Law-making and Practices of China''''s Textiles Industry and the Countermeasures of China

After accessing into the WTO, it is the obligation for Chinese government to guarantee some relevant domestic laws matching WTO rule and China's promise, and to make these laws be implemented in the whole country, and it is also a right for Chinese government to protect and develop itself by law. But WTO rule only could be applied in China by converted for the domestic laws. So the mission of law-making in the textile industry is very heavy, it is urge to make, perfect some new laws, at the same time, to tidy up, modify or abolish some laws, regulations and policies not to match with WTO rule. Therefore, it has special important realistic meaning and profound strategic meanings to study WTO rule's influence in the law-making and practices of China's textiles industry and the countermeasures of China.
