“宽严相济”视野下对少数民族“两少一宽”刑事政策的反思

民族问题在全球化进程中已成为国际社会广泛关注的重大问题。历史上形成的“少捕、少杀,处理上一般从宽”的少数民族刑事政策有其相当的合理性,是正确处理国家内部民族问题的重要政策,体现了对少数民族的人文关怀和司法宽容,在实践中得到了各族人民的认同,取得了良好的效果。但这项刑事政策也有其历史局限性,新形势下,应当以“宽严相济”刑事政策为基石,关注“两少一宽”政策的刑事法律化,丰富少数民族刑事政策的内涵,充分发挥各少数民族固有资源在控制犯罪中的作用。
