检察机关自侦案件监督机制研究

检察机关对职务犯罪案件既有侦查权,又有批准逮捕权和提起公诉权,应当建立多环节、多层次的内外监督机制。检察机关内部不同部门之间的横向监督以及上下级之间的纵向监督,可以从制度设计上进一步改革和完善,包括内部分工管辖制度、初查监督制度、侦查联动制度、办案人员责任制度等;同时,也可以采取多种措施不断完善外部监督机制,并在立法上规定对是否立案的审查监督制度、提前介入制度、复议复核制度、司法救济制度等,以使监督机制更加趋于完善。

A Study on the Supervision Mechanism of the Prosecutor-investigated Cases

The prosecution office has right to investigate public servants' crimes,to issue warrant of arrest to the suspect and to initiate public prosecution.Henceforth,a multi-ring and multi-layer supervision mechanism both inside and outside the prosecution office shall be established.From the inside persepective,the horizontal and vertical supervision mechanism in the different divisions of the prosecution office can be bettered and reformed in the sense of institutional arrangement,which include allocation of cases,preliminary investigation supervision,concerted investigation and investigators' responsibility,etc.Meanwhile,the outside supervision mechanism should also be improved with various measures.Whether a case can be placed on file,previous intervention,review and re-determination and judicial remedy shall be on the list of legislation in this regard to further the perfection of the supervision mechanism.
