论非法证据排除程序中的证明

非法证据排除程序中的证明主要是指当被告方主张控诉方的证据系非法所得时由谁承担证明责任以及证明应达到何种程度。根据证明责任的分担原理,对非法实物证据的排除,一般应由被告方承担证明责任,其证明达到"优势证据"即可;对非法自白的排除则应由控方负证明责任,其证明应达到"排除合理怀疑"程度。
