| 摘 要： | 涉农信访在整个信访总量中所占比重最大,其基本上以农地纠纷为内容。以保障村民自治为己任的《村民委员会组织法》在实施过程中被误用或滥用,这成为诸多农地纠纷的始作俑者。法院面对农地纠纷止步不前,农民转而求诸信访,但信访无法亦不应该成为解决农地纠纷的主要渠道,信访不能代替司法。信访工作当前面临制度困境与功能异化的现状,需要从正确厘定其与司法的关系出发,使回归本位,并发挥最大功效。
