浅谈雇主责任替代制度

摘    要:雇佣关系为现代社会之普遍现象,雇员在职务中损害第三人利益的情况也时有发生。我国应比较各国民法规定,出台详尽的规定:在归责原则问题上,应考虑到雇主较雇员资力悬殊的特别情况,在所有的情况下,让雇主替代雇员赔偿;在第三人确认上,应对雇员是否也属于第三人加以具体规定;在职务范围的认定问题上,应对雇佣关系转移加以规定;在雇员的行为是否要求构成侵权的问题上,应采用肯定的观点。
