| 摘 要： | 犯罪客体作为犯罪构成要件之一,受到刑法理论上的抨击。犯罪客体是刑法所保护而为犯罪行为所侵害的社会关系,犯罪概念首先是提示犯罪的本质属性———社会危害性,即犯罪行为对特定社会关系的侵犯,因此犯罪客体的意义已包含在犯罪概念中,应将犯罪客体排除在犯罪构成之外,犯罪客体不是犯罪构成的内容,而是犯罪概念的内容。

| Abstract: | As one of the most important factors of the const it ution of crime, criminal object is attacked by the theory of the criminal law. T he criminal object is of social relationship protected by the criminal law and d estroied by the crimes. This paper is going to expatiate on the position, the f unction of the criminal object, and the view and advice of myself as well from t he angle of the constitution of crime. |
