| 摘 要： | 民事主体制度的发展历史表明,顺应社会的现实需求,民事主体的范围在不断扩大——由过去的自然人、法人扩展到现在的非法人组织.判断非自然人团体具有民事权利能力的条件应当包括:稳定的组织、独立的意志和独立的利益.家庭在社会生产和生活中具有重要的地位和作用,家庭和家庭成员无论在财产享有、意志形成和责任承担等方面都具有相对的独立性,家庭的稳定性是其他组织无法比拟的.法律应当顺应现实的需要,赋予家庭以民事主体地位,使家庭和个人之间关系清晰、明确,既保障家庭的整体利益,也维护家庭成员的个人利益.
