论社会管理法治化的基本要素

社会管理的法治化是我国“依法治国,建设社会主义法治国家”的治国基本方略在社会管理中的具体化,它有经济、政治与思想文化的基础。社会管理法治化的治理模式是实现“社会本位”;社会管理法治化的基本内涵是建立市民和村民是社会管理最重要主体的体制和机制,并对国家机关和国家机关工作人员实行有效的控权;社会管理法治化的基本原则,包括：民主化原则、社会化原则、科学化原则和长效化原则;社会管理法治化的协同性关系有：立法、执法和守法的协同性关系,公民、社会组织与政府参与社会管理的协同性关系．行政、经济、教育、法律等社会管理手段协同性关系。

On the Basic Elements of Rule of Law in Social Management

Rule of law in social management embodies China＇ s basic strategy of governing the country as ＂rule of law and building a socialist country ruled by law＂ in respect of social management. It has economic, political and ideological and cultural bases. The mode of rule of law in social management is the realization of ＂social standard＂. The basic connotation of rule of law in social management is to establish the system and the mechanism, in which citizens and villagers are the most important main bodies of social management, and to control the rights of the state organs and functionaries of state organs effectively. The basic principles of rule of law in social management, include the democratization principle, the socialization principle , the scientific principle and the long-acting principle. The cooperativity relationships of rule of law in social management include the cooperativity of legislation, law enforcement and law abiding, the cooperativity of the citizen, the society organizations and government participating in social management, the cooperativity of administrative means, economic means, educational means and legal means and other social management means.
