The anticompetitive examination of intellectual property refusal of transaction is a common difficult issue in antimonopoly law all over the world.The standard of evaluating whether it is illegal to refuse to license is pretty indistinct because of the conflicts between protection of intellectual property and controlling of market monopoly,as well as the clashes between principle of fair competition and freedom of contract in antimonopoly law.Meanwhile,it is extremely complicated to evaluate and decide if a particular action of refusal of transaction is illegal.A very important way is to promote the examining system and make it reasonable and scientific,with the principle of equating intellctual property and others property rights.It is necessary to construct an analytical method by which we can assess property by the following four aspects：the dominant position of the intellectual property owner in the market,the ways of refusal of transaction,harms to competition of the refusal,the reasonable justifications of refusal.
