| 摘 要： | 如何判断“行政违法” ,我国现行的行政法和行政诉讼法研究理论虽有涉及 ,但都略显抽象、难以操作。因此 ,准确界定司法实务中的“行政违法”标准 ,并对司法实务中疑难问题的判断方法作一些实质性探讨 ,目的是服务于行政诉讼 ,并促进依法行政 ,切实保护当事人的合法权益。
