| 摘 要： | 刑法修正案(八)规定未成年人犯罪不构成累犯,那么未成年人犯罪前科还能否作为酌定从重处罚情节,对这一问题存在两种截然不同的观点。深入分析可以发现,现行的对未成年人犯罪前科一律不进行法律评价或无限期进行法律评价两种处置模式都存在较大问题,解决问题的根本出路在于建立层级式的前科评价体系。

| Abstract: | According to the Eighth Amendment to the Criminal Law the recidivist system cannot apply to juvenile delinquency. and there＇re two completely different viewpoints on whether the criminal record ean be regarded as a cireumstanee for severe punishment. An in-depth analysis reveals that therere big problems in the existing two modes, no legal evaluation and indefinite legal evaluation, so the fundamental way to solve the problem is to establish the hierarchical evaluation system of criminal record. |
