| 摘 要： | 犯罪化是刑法演进中一个永恒的主题,犯罪化在一定时期内仍然是我国刑事领域的重要课题.犯罪化的具体实施受社会状况、科技发展、国际刑事合作、刑法观和法益保护等相关因素的影响,综合考察这些因素的实际状况才能使犯罪化在社会秩序与个人权利之间保持一种适度的平衡.在犯罪化的过程中,立法者和司法者除了要受到社会方面和法律方面因素的制约外,还应该遵守谦抑性、合法性与可行性等基本原则.
