| 摘 要： | 信息网络传播权有别于复制权、发行权和广播权,是一种独立的著作权权利.刑法应对<著作权法>规定的一些著作权侵权行为予以犯罪化;规避或者破坏网络技术措施的行为应该在现有刑法框架内可以得到较好的解决,而不必进行新的刑事立法;对网上提供、传播国家禁止出版、传播的作品之行为,应加大打击力度.
