弱势群体被害人刑事司法权利保护的比较法考察

国外弱势群体被害人享有知情权、受保护权、补偿权和法律援助权等特殊刑事司法保护的权利,其权利创设的重点是和被告人权利不相冲突的领域,其重点保护的对象是儿童、妇女和贫困人口等部分弱势群体被害人.借鉴国外立法的经验,在设立我国弱势群体被害人刑事司法保护制度时,要注意两点:一是不要在削弱被告人权利保护的基础上创设制度,二是要注意保护对象的全面性和保护方式的多样性.
