侦查阶段涉案财产处置问题研究

涉案财产包括作为犯罪之物、作为证据之物和可为财产保全之物.涉案财产的程序性处置包括涉案财产的管理、随案移交和移送,目的是保证涉案财产的合法性、完整性、有效性,防止涉案财产证据价值的丧失以及财产价值的损毁;实体性处置包括没收和返还被害人.应建立侦查机关提请人民法院裁决涉案财产的特别程序,用来处理侦查中出现的一些特殊情况,包括被害人申请返还合法财产;因特殊原因难以追诉等情形.司法实践中撤销案件时涉案财产的处置问题也不容忽视.
