关于劳动教养制度基本问题的思考

劳动教养制度问题是近年理论界争论激烈的问题之一，随着禁毒法的实施，劳教制度面临着巨大的挑战。在新的历史关口，劳动教养的出路在何方？首先在方法上，必须要有创新，其次在立场上，必须处理好几种关系：理论研究者与制度的决策者、执行者之间视觉上的关系；制度设计与制度实际运作之间的关系；西方化与本土化关系等。在此立场上，再进行制度的选择和设计。
