| 摘 要： | 浮动抵押制度在融资担保方面有许多固定担保难以比拟的优势,但浮动抵押的不确定性也使抵押权人面临着巨大的风险。为了维护债权人的利益,采用浮动抵押的国家都对设定浮动抵押的主体、标的、登记、浮动抵押确定及浮动抵押的实行进行了相应的规定。本文在对国外立法及判例分析的基础上,提出了对我国浮动抵押制度完善的建议。

| Abstract: | Floating charge has great advantage in financing comparing to the fixed mortgage,but,due to its floating feature,it also has great risks for the mortgagee.In order to protect the creditor' right,countries that adopted floating charge make stipulations on the subject,object,registration,crystallization and fulfillment of floating charge.This article firstly analyzes the foreign legislations and precedents,and then gives suggestions on our country's floating charge. |
