| 摘 要： | 区域限批强调个别违法导致群体受罚，具有连带性、层级性、面源性、惩罚性和高行政性特点。它和环境影响评价制度和限期治理制度相区别又联系。在法律性质上是行政惩罚而不是行政许可，区域限批在区域层面上实现了更高级别的公平，其行政相对人是地方政府和排污企业的共同体，文章还对区域限批制度的法律构建、法律构成提出了框架性建议。
